Acceptable Use Policy
This Acceptable Use Policy (“AUP”) governs your use of the Synthfy AI Receptionist service (“Service”) provided by Synthfy LLC. By using the Service, you agree to comply with this policy. This AUP is incorporated by reference into our Terms of Service.
1. Prohibited Activities
Illegal & Fraudulent Use
- Using the AI receptionist for illegal solicitation, scam calls, or fraud of any kind
- Conducting activities that violate any applicable local, state, federal, or international law
- Using the Service to facilitate or promote illegal transactions or activities
Impersonation & Misrepresentation
- Impersonating government agencies, law enforcement, or emergency services
- Impersonating medical providers, legal professionals, or financial advisors
- Impersonating real individuals or other businesses
- Providing false or misleading business information during signup or configuration
Unsolicited Communications
- Using the Service for robocalling, automated telemarketing, or spam
- Initiating outbound calls or messages without proper recipient consent
- Violating the Telephone Consumer Protection Act (TCPA) or similar regulations
Service Abuse & Technical Violations
- Attempting to reverse-engineer, decompile, or disassemble the Service or its underlying technology
- Deliberately overloading, disrupting, or interfering with the Service infrastructure
- Attempting to bypass usage limits, security measures, or access controls
- Using automated tools or bots to abuse the Service beyond normal use
- Sharing account credentials or reselling access without authorization
- Creating multiple accounts to abuse free trial offers
Harmful & Abusive Content
- Using the AI receptionist to harass, threaten, or intimidate callers
- Configuring the AI to deliver hateful, discriminatory, or abusive messages
- Recording calls for purposes not disclosed to callers
- Using the Service to collect sensitive personal information (SSN, credit card numbers, medical records) beyond what is necessary for legitimate business purposes
2. Healthcare & Medical Use Restrictions
Synthfy is not HIPAA-certified and does not offer Business Associate Agreements (BAAs). You may not use Synthfy to transmit, store, or process Protected Health Information (PHI), serve as the primary communication system for clinical patient care decisions, or handle calls involving emergency medical triage or clinical diagnosis.
Synthfy may be used for administrative, non-clinical tasks only — such as scheduling appointments, answering general office hours questions, and capturing contact information for callback.
3. Call Recording Compliance
Synthfy automatically discloses call recording at the beginning of every call to comply with federal and state wiretapping laws, including two-party consent states. Users must not attempt to remove, disable, or modify this mandatory disclosure, record calls through external means without proper consent, or use call transcripts for purposes not disclosed in our Privacy Policy.
4. AI Identity Disclosure (California SB 1001 & SB 942)
Under California SB 1001 (Bolstering Online Transparency Act), it is unlawful to use a bot to communicate with a person in California with intent to mislead about its artificial identity. Every call handled by the Synthfy AI Receptionist begins with a clear, conspicuous disclosure that this is an AI-powered virtual receptionist — this disclosure is mandatory and cannot be disabled.
Users must not configure the AI to deny it is an automated system, instruct the AI to claim to be human, or use the Service to deceive callers about the nature of the interaction. California law imposes penalties of up to $2,500 per violation under the Unfair Competition Law.
5. SMS & Text Messaging Rules
- You must have express written consent from recipients before sending any marketing SMS
- All SMS messages must include clear opt-out instructions (“Reply STOP to unsubscribe”)
- You must immediately honor all STOP requests — this is automated by Synthfy’s platform
- Outbound SMS uses the shared toll-free number +1 (888) 958-1468, white-labeled with your business name
- You must not send SHAFT content (Sex, Hate, Alcohol, Firearms, Tobacco/Cannabis) via SMS
- All SMS activity must comply with TCPA and carrier 10DLC regulations
6. Enforcement & Consequences
Violation of this AUP will result in immediate account termination without refund. Synthfy may suspend or terminate your account, remove or disable access to content that violates this policy, withhold any refunds, report illegal activities to law enforcement authorities, and pursue legal remedies for damages caused by policy violations.
7. Monitoring & Reporting
Synthfy monitors usage patterns to detect violations through automated analysis of call volumes, usage patterns, and content flags. To report misuse: [email protected] — all reports reviewed within 48 business hours.
8. Your Responsibilities
As a Synthfy user, you are responsible for ensuring compliance with all applicable laws, providing accurate business information, maintaining the security of your account credentials, and promptly reporting any unauthorized use of your account.
