Terms of Service
Please read these Terms of Service carefully before using Synthfy LLC. By accessing or using our service, you agree to be bound by these terms. This Agreement is between Synthfy LLC, a Texas limited liability company (“Company”), and the individual or entity accessing our services (“Customer”).
1. Service Description
Synthfy provides an AI-powered virtual receptionist service including: inbound call answering and routing via AI; two-way SMS texting; calendar and appointment scheduling; lead capture and management; call recording and transcription; custom business greeting configuration; dashboard analytics and reporting; and bilingual English / Spanish support at no extra cost.
2. Eligibility
You must be at least 18 years old with legal authority to bind your business to this agreement. You represent that your business is legally registered and operating, all information provided during registration is accurate, and you will not use the service for any illegal purpose.
3. Account Registration
You must create an account with accurate business information, verify your email address, provide valid payment information through PayPal, maintain the security of your account credentials, and notify us immediately of any unauthorized use.
4. Subscription Plans & Pricing
We offer subscription tiers billed by AI call minutes and call volume. Annual billing is available at a 20% discount. See our Pricing Page for current rates.
5. Free Trial
We offer a 7-day free trial: PayPal method must be verified before activation; one trial per business entity; includes 30 minutes of AI call time; automatically converts to paid Starter plan ($19/mo) unless cancelled; reminder email sent 3 days before trial end.
6. Payment Terms
All payments are processed through PayPal. You authorize recurring billing at your selected plan rate. Failed payments are retried 3–5 business days. Synthfy reserves the right to adjust pricing with 30-day advance notice. Yearly plans receive a renewal reminder 30 days before the anniversary date (California AB 2863).
7. Cancellation & Refunds
Cancel anytime through your dashboard. Service continues until the end of the current billing period. See our Refund Policy for full terms.
8. Acceptable Use
You may not use the Service for illegal solicitation, fraud, impersonation of government agencies or emergency services, robocalling, spam, or reverse-engineering the AI model. Violation results in immediate account termination without refund. See our Acceptable Use Policy for full details.
9. AI Disclosure & Call Recording
Every call begins with a mandatory hardcoded disclosure identifying the business, informing callers they are speaking with an AI receptionist (California SB 1001), and notifying of recording (two-party consent compliance). This disclosure cannot be removed or disabled.
10. Phone Numbers
Phone numbers are licensed to Synthfy LLC and assigned to your account. They are not transferable or portable and are released upon cancellation.
11. Data Privacy & Security
All data is encrypted in transit (TLS 1.2/1.3) and at rest (AES-256). See our Privacy Policy and Data Processing Addendum.
12. Not a Healthcare Provider — No HIPAA
Synthfy is not HIPAA-certified, does not offer Business Associate Agreements (BAAs), and is not suitable for transmitting Protected Health Information (PHI). Use Synthfy for administrative, non-clinical tasks only (scheduling, lead capture, general inquiries).
13. Intellectual Property
The Service, including its AI models, algorithms, software, design, and content, is the exclusive property of Synthfy LLC. You may not copy, modify, distribute, reverse-engineer, or create derivative works based on the Service.
14. Limitation of Liability
Synthfy’s total liability shall not exceed the amount paid by you in the preceding 12 months. We are not liable for indirect, incidental, special, or consequential damages. The AI receptionist is provided “as is.”
15. Indemnification
You agree to indemnify and hold harmless Synthfy LLC from claims arising from your use of the Service, violations of these Terms, or content you provide through the Service.
16. Dispute Resolution
Disputes are governed by the laws of the State of Texas and subject to binding arbitration in Harris County, Texas, on an individual basis (no class actions).
17. Modifications
Material changes will be notified via email or dashboard at least 30 days before taking effect. Continued use constitutes acceptance.
